The purpose of the ordinance is to ensure employees of all types are appropriately compensated for their work.<\/p>\n<p><strong>The eight key statutory entitlements identified in legislation are:<\/strong><\/p>\n<ul>\n<li>holiday pay;<\/li>\n<li>annual leave pay;<\/li>\n<li>sickness allowance;<\/li>\n<li>maternity leave pay;<\/li>\n<li>paternity leave pay;<\/li>\n<li>end-of-year payment;<\/li>\n<li>payment in lieu of notice; and<\/li>\n<li>amounts to remedy unreasonable and unlawful dismissal.<\/li>\n<\/ul>\n<p>\u201cEmployers should comply with the 713 Ordinance and calculate statutory entitlements on a 12-month average wage basis,\u201d Miles says.<\/p>\n<p>Correct calculation of wages for individual staff members is crucial to avoid incorrect statutory entitlement figures.[\/vc_column_text][vc_custom_heading text=&#8221;Changes to payroll law&#8221; use_theme_fonts=&#8221;yes&#8221; el_class=&#8221;m-b-20 f-30-b&#8221; css=&#8221;.vc_custom_1687328387717{padding-top: 20px !important;}&#8221;][vc_column_text el_class=&#8221;m-t-20 m-b-20&#8243;]The legislative landscape in Hong Kong is unique and constantly changing. A significant amendment was made on 1 May 2023, when the region\u2019s statutory <a style=\"font-size: 16px; cursor: pointer; font-weight: normal;\" href=\"https:\/\/www.labour.gov.hk\/eng\/news\/mwo.htm#:~:text=The%20current%20SMW%20rate%20is,effect%20from%201%20May%202023.\" target=\"_blank\" rel=\"noopener\">minimum wage rate<\/a> increased by 6.7% to HKD40 per hour.<\/p>\n<p>Changes to payroll legislation can be very technical and may only impact a few employees in select industries. For example, in April 2023, the Hong Kong Legislative Council passed the Occupational Safety and Occupational Health Legislation (Miscellaneous Amendments) Bill 2022 (\u201cthe Bill\u201d). This Bill amended the Factories and Industrial Undertakings Ordinance (Cap. 59), the Occupational Safety and Health Ordinance (Cap. 509), and their subsidiary legislation.
